These Terms of Service ("Terms") govern your use of the Arqen mobile application (the "App"), our website at arqenhause.com, and the construction, renovation, design, and related services provided by Arqen Haus Corp. ("Arqen," "we," "us," or "our") in Toronto and the Greater Toronto Area (collectively, the "Services"). By downloading the App, creating an account, browsing our website, or engaging Arqen for construction services, you agree to these Terms. If you do not agree, do not use the App, our website, or our Services.
Arqen is a construction and contracting company serving Toronto and the GTA, offering full home renovations, custom home builds, pools, spas, landscaping, and related design and project management services. The App is a companion tool for scanning spaces, designing in 2D/3D, previewing builds in AR, browsing land listings, communicating with your project team, and managing your project.
You must be at least 18 years old and able to form a binding contract to use the App or engage our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information when creating an account or requesting a quote, consultation, or financing.
The App lets you scan rooms and lots using your device's camera and LiDAR sensor, generate floor plans, design in 2D/3D, preview builds in AR, browse vacant land listings, message your project team, and track project milestones and documents. Room scans, AR previews, floor plans, renderings, land listings, and cost estimates generated in the App are for planning and illustrative purposes only. They are not final architectural drawings, engineering documents, appraisals, land surveys, or binding quotes, and actual builds, costs, materials, timelines, and site conditions may differ. Any final design, cost, and scope of work will be set out in a separate written construction contract or change order signed by both parties.
If you engage Arqen to perform renovation, custom home construction, pool, spa, or landscaping work, that engagement is governed by a separate written construction contract that will set out the scope of work, price, payment schedule, timeline, permits, warranties, and change order process. These Terms govern your use of the App and website; in the event of a conflict between these Terms and a signed construction contract regarding the performance of construction work, the construction contract controls. Construction timelines are estimates and may be affected by permitting, weather, supply availability, inspections, and other factors outside our control.
Requests for a free quote, consultation booking, or financing match made through the App or website are not binding offers or approvals. Financing options are provided by third-party lenders and partners, and their terms, rates, and approval are determined solely by those third parties; Arqen is not a lender and does not guarantee approval or specific terms.
Vision Pass is an optional, auto-renewing subscription purchased through the App Store that unlocks unlimited saved designs, full design history, lot-accurate AR previews, and a discount toward a project built with Arqen. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your device's subscription settings. Payment is charged to your Apple ID account at confirmation of purchase and at renewal. Prices are subject to change with notice as required by Apple's guidelines. Discounts toward a build are subject to the terms of your separate construction contract and current promotions at the time of contracting.
You agree not to: use the App or Services for any unlawful purpose; upload content you do not have the right to share; attempt to reverse engineer, scrape, or disrupt the App or our systems; impersonate any person or entity; or use land listing or scanning features to misrepresent property you do not own or have permission to scan.
The App, our website, our logo, and all associated content, design, and software are owned by Arqen or our licensors and protected by intellectual property laws. You retain ownership of the room scans, designs, photos, and other content you upload, but grant Arqen a license to use that content as needed to provide the Services, quote your project, and deliver your build.
The App relies on third-party services including Supabase (data and backend infrastructure), Apple (Sign in with Apple, push notifications, App Store payments), RevenueCat (subscription management), and Mapbox (mapping and location features). Your use of these features is also subject to those providers' own terms and privacy policies.
The App and website are provided "as is" and "as available" without warranties of any kind, express or implied. Arqen does not warrant that the App will be uninterrupted, error-free, or that scans, renderings, AR previews, or cost estimates will be fully accurate. Construction services are performed subject to the warranties expressly set out in your signed construction contract and any warranties required by applicable law; no other warranty on construction work is made through the App, website, or these Terms.
To the fullest extent permitted by law, Arqen and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or website, including reliance on any design, scan, AR preview, or cost estimate generated in the App. Liability arising from construction services performed under a signed construction contract is governed by that contract and applicable law.
We may suspend or terminate your access to the App or account at any time if you violate these Terms. You may stop using the App and delete your account at any time through Profile → Account Settings or by contacting us. Termination of your App account does not affect the terms of any active construction contract.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms from time to time. We will update the "Last updated" date above when we do, and continued use of the App or Services after changes take effect constitutes acceptance of the revised Terms.
